The King against John Coe< no role > for Felony
(as a Receiver).

John Coe< no role > of East Smithfield in the County of Middlesex Victualler (the
Defendant in this Cause) and William Berkley< no role > Clerk to Charles Toothaker< no role > of the
Parish of Saint Sepulchre London Sollicitor for the said Defendant, Severally
make Oath as follows, and Foist this Deponent John Coe< no role > for himself Saith
that William Bedford< no role > of Ratcliff Highway near St. Georges Church in the
County of Middlesex Grocer who is a Material Witness for this Deponent on the
Tryal of this Cause, and without whose Testimony he Cannot Safely Proceed to the
Tryal thereof, was at the Time of the Service of the Notice of Motion Hereunto
Annexed, and now is on a Journey at or about Lynn and other Parts of the County
of Norfolk and will not Return to London till the Latter End of this Present
Month of December, as this Deponent Coe is Informed by the Wife
of the said William Bedford< no role > at his Dwelling House, and which this
Deponent Verily believes to be True; and this Deponent Saith that the said
William Bedford< no role > will Certainly be in London before the said next Ensuing
January Sessions, as this Deponent is also Informed by His said Wife
and verily believes to be True, at which Time this Deponent John Coe< no role > will
be ready to take his Tryal on the Bill of Indicment Preferred against
him in this Cause; And this Deponent William Berkley Maketh Oath
and Saith that he this Deponent Did on the Second Day of this Instant
December Leave a True Copy of the said Notice of Motion Hereunto
Annexed with William Gibson< no role > one of the Clerk's or Servants to
Cole Esquire Sollicitor of the Honourable the East India Company and in the
Prosecution of this Indictment at his Dwelling House Scituate in Basinghall
Street in the City of London , which said William Gibson< no role > Promised to
Deliver the said Notice to his Master the said Mrs.Cole.
