Evidence severally make oath & each speaking for
himself a herself saith that neither of them hath directly
or indirectly received any Sum or Sums of money
or any Security or indemprity for or by means of not
prosecuting the above named Dept. for stealing a Silver
Mug the property of the sd. Mary Smith< no role >
; but on the
contrary say that at the last Sessions they preferred a
Bill of Indictmt. agt. him & did appear in open Court of
the Old Baily
in order to prosecute the came, & as far as
severally concerns there Deponents they were ready at
any other time to have appeared for that purpose, a
further they severally say that they know nothing at
all concerning any moneys having been remitted
here by the Defendts. Father or any other person in order to
pay the Forfeiture of their Recognizance and further
the Deponent Mary Smith< no role >
saith that several persons
of figure a reputacon having applied to this Deponent
& represented the Defendt. to be the Son of a Gentleman
of good Family & Estate & that it wod. be an inconsolable
Concern to the Family, if he was further prosecuted,
& the names of several Aldermen of this City having
been mentioned to her to whom (it was said) it wod. be
very acceptable if she did not further prosecute, those
& those only were the reasons of her extending her
merciful disposition towards him.
