John Boyd< no role > Servant to John Cates< no role > of the Strand Pawn broker maketh
Oath and saith that he was bound by Recognizance to give Evidence at
the Session held for the County of Middlesex in the Month of April last against
one George Bibbs< no role > for feloniously stealing a watch the property of one
Thomas Marshall< no role > And this Deponent saith that he made an
appointment with the said prosecutor to call on him this Deponent in Order
to have proceeded together to the Session's House to prefer an Indictment
against the said George Ribbs< no role > and prosecute the same according to the
Condition of his said Recognizance; And this Deponent saith that he waited
at home in expectation of the said prosecutors calling on him for the purpose
and in pursuance of his appointment as aforesaid, but that the prosecutor
never did call on him, upon which this Deponent as the Session drew near
to a conclusion went to the prosecutor to remind him concerning his said
Recognizance and with intention to have attended him to the Sessions
House to prosecute the said Prisoner, when to his this Deponent's great
surprize he was informed by the said prosecutor that he had been to the
Session house and had preferred an Indictment against the said prisoner
which had been returned Ignorances by the Grand Jury, And this Deponent
further saith that on expostulating with the prosecutor on his not having
called on him this Deponent pursuant to his appointment for that purpose
the prosecutor said that he Deponent had not been asked for and therefore
he did not think Deponents attendance was necessary, And Deponent
further saith that he imediately attended at the Sessions House to be
advised what he should do to save his Recognizance when he was
informed and advised that he should prefer an Indictment against the
said prisoner, And this Deponent further saith that he did at the
same Session prefer an Indictment against the said prisoner at his
this Deponents own expence but which Indictment the Grand Jury
also returned Not Found, And lastly this Deponent saith that he
did not neglect to attend to give Evidence against the said prisoner
