Oath and saith that the said James Dunn< no role > was Indicted at the Session
of Oyer and Terminer held for the City of London in the Month of September
last for feloniously uttering and publishing as true a certain false forged and
counterfeited Will and Testament purporting to be the last Will and Testament
of John Potter< no role > deceased knowing the same do be false forged and Counterfeited
with Intention to defraud The United Company of Merchants of England
trading to the East Indies and with intention to defraud Thomas Newte< no role >
David Cameron< no role > Henry Spencer< no role > John Coggan Robert Maugles and S [..]
James Esdaile< no role > Knight and also with Intention to defraud Ynyr
Burges
< no role > and also with Intention to defraud Jenny Potter< no role > Widow
against the form of the Statute in such case made and provided And
this Deponent further saith that previous to the said James Dunn< no role > 's
Commitment to prison for the Crime aforesaid probate of the said Will [..]
Testament had been granted by the prerogative Court of the Archbishop of
Canterbury to the said James Dunn< no role > as this Deponent hath been informed
and verily beleives And this Deponent having been advised that the
said James Dunn< no role > could not be properly tried on the said Indictment
until the said probate had been called in and revoked by the said
prerogative Court this Deponent hath on behalf of the prosecutors of
the said Indictment employed Messrs Lushington & Heseltine
Proctors in Doctors Commons to commence the necessary proceeding [..]
in the said Court for the purpose of having the said probate called
in and revoked And a Citation bearing date the Twentieth day of
September last duly issued by the said prerogative Court for the purpose
aforesaid hath been served on the said James Dunn< no role > as this
