James Dunn< no role > the abovenamed Defendant Maketh Oath That he has
been in prison in the Goal of newgate and the poultry Compter for Thirteen Weeks and upwards and through some
Affidavit made on the partof the prosecution his Trial was
postponed the last Sessions and he has now three very material Evidences
in Town John Powell< no role > Richwald Neal< no role > and Lawrence Leonard ready to appear in his Behalf and without the Benefit of whose
Testimony he cannot with safety receive his Trial This Deponent Saith The said
Witnesses are Mariners and must unavoidably go to Sea as he is not in any
respect able to support them in Town until next Sessions That he is in want
of the common necessaries of life which with the danger of a Gaol Distemper
he Appretunds he can not Service in his Present State untill next Sessions Therefore
Prays to bedischargedimmediately brought to Trial
