Thomas Lermith< no role > of Aldgate London Muns Mercer< no role > Maketh Oath
that on or about the Eighth day of November last this Deponent
laid an Information against the said William Annand< no role > for receiving
a price of Volvent the property of this Deponent knowing the same
to have been Stolen to him from this Deponent Entered into a
Recognizance to prosecute the said William Annand< no role > forth said Offence
and which was found a true bill And this Deponent further saith he
was informed that as the Defendent had been admitted to bail it was
Necessary he should give notice of the time huntended to Surrender
himself and take his Trial and then fore this Deponent for
that Reason and under this Idea only did not alleud at the
last Sessions to prosecute this and William Annand< no role > and the said
William Annand< no role > attending on the last day of the said Sessions
and Surrendering himself to take his Trial knows acquitted of
the said ofence And this Deponents said recognizance was
ordered to he Estreated And this Deponent further Saith that
was at all times willing and desirous to have prosecuted the
said bill of Indictment and would Travese done had it not been
for the Misinformation Which [..] thus it was
Absolutely necessary for the said William Annand< no role > to have given
this Deponent Notice of the time of Trial And that he did not
omit to Attend to give Evidence against the said William
Annand< no role > out of favor to him or with design he should Escape
Justice for on the Contrary this Deponent had the most Earnest
desire that the said William Annand< no role > should be Convicted
