John Shutt< no role > of Shoreditch in the County of Middlesex Grocer the
Prosecutor in this Cause maketh Oath and saith that he this Deponent
together with his Servant Thomas Moses< no role > being bound by Recognizance
to prosecute and give Evidence against the said Richard Beard< no role > for
Stealing a quantity of Soap the property of this Deponent attended
on Tuesday the ninth day of December instant at the Session of the
peace for the County of Middlesex and preferred an Indictment
to the Grand Jury there against the said Defendant And this
Deponent further saith that he and his said Servant attended
at the Session of Gaol Delivery of Newgate holden for the said
County at Justice Hall in the Old Bailey on Wednesday the Tenth
day of December instant and also on the Thursday and Friday
following in order to give Evidence against the said Defendant
on his Trial but the same did not come on and this Deponent
also attended on the Saturday following till about eleven
o'Clock in the forenoon when this Deponent was informed
by a Person who he believes attended the said Court as
a Door Keeper that the London Jury were to sit in the Afternoon
and from such Information this Deponent believed that the
Trial of the said Defendant would not come on that Afternoon
And this Deponent saith that being afflicted with a very
bad Cold by reason of such Attendance and believing from
the Information he had received that the Trial of the said Richard
Beard
< no role > would not come on that Afternoon he this Deponent
went home And on Monday Morning following this Deponent
and his said Servant attended at the said Sessions at
Justice Hall aforesaid when he this Deponent was informed
that the said Richard Beard< no role > had been called up to be
