The King on the prosecution
of Alexander Hart< no role > Esquire

for Grand Larceny

David Main the above Defendant maketh Oath and
saith that on the Ninth day of November last he this Deponent
was committed to New Prison for a supposed offence for stealing
sundry things the Property of Alexander Hart< no role > Esquire and was
discharged by the Court of Kings Bench ten Bail to appear at
the present Sessions to answer the said Complaint And this
Deponent saith that he immediately wrote nets Scotland and
with great difficulty prevailed on John Slorach of the City of
Edinburgh TaylorandRalph Bowie Writer at Dunformline
and Andrew Main of Dunformline aforesaid Merchant all
material and necessary Witnesses for this Deponent to come up
from Scotland, at this Deponent Expence, on purpose to give
Evidence on behalf of this Deponent and for no other purpose
whatsoever And this Deponent further saith that all the said
Witnesses are now come up and are in Town ready to give
Evidence for this Deponent And that in Case the above
Indictment is not tried at this present Sessions of Gaol
Delivery he verily believes that he shall be deprived of the
benefit of their Testimony, as they have severally declared to
this Deponent that they will not stay any longer in London
for the purpose of giving Evidence for this Deponent, but will
return home to Scotland and that they will not either of them
come up again for that purpose, neither can this deponent
afford to pay the great Expence that has, and will attend
the said Witnesses coming up And this Deponent further
saith that Thomas Mackies of Jewin Street London
Accountant who is a very material Witness for this Deponent
