Neglecting to do the same was become forfeited and would be
Estreated which very much Surprized this Deponent who positively
saith that till that time he did not know that he was bound over to
give Evidence against the said Two prisoners nor did the Clerk to the
Magistrate or the Magistrate himself inform or by any means give
this Deponent to understand that his Name was put into any Recognizance
or that he was bound over nor did they or either of them read over to this
Deponent the Condition of any Recognizance or ask whether he was content
which this Deponent is informed and believes is the Method always read
when a person is bound in a Recognizance therefore this Deponent
saith that such Recognizance was drawn up and this Deponent Name
inserted therein entirely without this Deponents privity or knowledge
and this Deponent saith that if he had received any Notice from the
prosecutor or the Magistrate or any other person or if he had known
any Recognizance had been drawn up in his Name he would have
appeared and given his Evidence against the said prisoners and this
Deponent saith he has been a pawnbroker upwards of Eight Years
but never appeared or entered into a Recognizance to appear at the old
Bailey on account of having received anything from any person or
persons Tried there and that this Deponent did not neglect to appear
and give Evidence against the said prisoners for any favour or
Affection or for any Reward or the hope or promise thereof but that it
was entirely occasioned by this Deponents not knowing that his attendance
was required or necessary and for no other reasoner motive whatsoever
Therefore this Deponent humbly prays this Honourable Court will be
pleased to order his said Recognizance to be discharged.
