the said Charge other then his Property in the Goods so Stolen
and that the said Esther Beazley< no role > this Deponents said Servant
who could have given Material Evidence against the said Prisoners
touching the said Felony was gone from this Deponents Service
so that this Deponent could not tell where to find her to get her to
Appear at the said Session pursuant to the Condition of the said
Recognizance And this Deponent Saith That the said
Prisoners was discharged at the said Session for want of
Prosecution whereby this Deponents said Recognizance became
Forfeited And this Deponent Saith That he did not Neglect to
Attend at the said Session to Prosecute the said Prisoners for the
Offence aforesaid through any favour or Affection toward the said
Prisoners or either of them or for or by or through any Profills Gain
or Rewards or the hope or Promise thereof but that such his this
Deponents Negelect to Attend pursuant to the Condition of his said
Recognizance was by the persuasion and Assurances of the said
Mr. Cresse, the Constable to whom this Deponent Applyed for Advise
as aforesaid and that he this Deponent immagine that
would be of no Use for him this Deponent to Appear and
Prosecute the said Prisoners as he could not give Sufficient or
any Evidence to prove the said Charge and did not know where
to find out his said Servant and for no other reason or Motive
whatsoever
