John Savage< no role > For Felony

Thomasine Latham< no role > Wife of John Latham< no role > of the Parish
of Saint Giles in the Fields in the County of Middlesex
Gentleman And Sarah Wilson< no role > of the same Spinster
and John Latham< no role > the Younger of the Parish of
St. Sepulcre London Baker Severally make Oath and
Say And first these Deponents Thomasine & Sarah for
themselves Say that they on the Monday in last February
Session Preferred and formed an Indictment against
the said Defts at Hicks Hall for Felony And that they
Attended at the Old Bailey on the Wednesday following
to give Evidence there But the Defts Names not being
on the List they did not apprehend the said Depondts
would be that Day Tryed And was so Informed by
several of the Officers Attending the Court Andfurther
this Deponent Thomasine further Saith That being very
Infirm and Ill she after Attending till about four
o'Clock in the afternoon went to get Refreshment
and look the other Depont Sarah her Servant with hole and sent
the Deponent John her Son to Attend for herd And this
Deponent John Latham< no role > Saith that he did accordingly
Attend at the Old Bailey till abt. six in the afternoon
and the Defts not being on the List and he being also
Informed by some of the Officers of the Court of whom he
Enquired that it Could not Possibly Come on that Evening
he went away And after [..] he was gave that Night It Seemes
the said Defts ever putt to the Barr and Acquited And
all these Deponents Say that it was not any Wilfull Error
in either of them but Nearly thro Mistake that the said Defts
were so Acquitted
