on the Prosecution of Richard

Richard Rossiter< no role > Clerk to John Vernon< no role > of Southampton
Building in the County of Middlesex Gentleman maketh
Oath That on Sixth day of April instant he preferred
a Bill of Indictment against the Prisoner for privately
Stealing a Brass Stewpan and Copper Cover of this
Deponent's Property and this Deponent being informed
and which he believed to be true) that the Indictment
would not be brought on the Hearing on that day (it being
near two of the Clock in the afternoon when the same
was preferred) and this Deponent having Orders from
his Master to return to his Business as soon as the
Indictment was preferred and this Deponent being
informed (and which Information he Verily believed
to be true) that the Prisoner could not be discharged for
want of Prosecution till the end on the present Sessions
at the Old Bailey , was the Reasons that this Deponent
did not attend at the Old Bailey on the Pray to Prosecute
the said Indictment But this Deponent being desirous
of Prosecuting the said Indictment with Effect did on the
next day being the seventh day of this Instant April about
Eleven of the Clock in the forenoon Attend with his Witness
at the Old Bailey for that purpose when he was informed
that the Prisoner was discharged the Evening before for
want of Prosecution And this Deponent on his Oath further
Saith that he did not neglect attending to Prosecute the said
Ann Ashton< no role > out of any favour to her or in any way to
Screen her from the Felony aforesaid but meerly from the
Information received as aforesaid and for us other reason
or Molive whatsoever
