William Harrison< no role > of Cavendish Street in the Parish of Saint Mary
le bone in the County of Middlesex Baker maketh Oath and saith that he
being bound by Recognizance in the sum of Twenty Pounds to prosecute one
Michael Snowden< no role > for Stealing from this Dept. one Bushel of Wheat flour
of the Value of five Shillings did on Friday in last July Sessions Preferr an
Indictment against the said Michael Snowden< no role > for the said offence, which
Indictment was found a true Bill, and this Dept. there upon came the same
Friday to the Old Bailey to attend to give Evidence on the said Indictment
but having some discourse with a person who attends at the Old Bailey as a
Constable or same such Officer, and whose Name this Dept. upon enquiry
hath been informed is William Smith< no role > , told this Depont. that the said
Michael Snowden< no role > 's Trial would not come on that day, the said Snowden not
being brought from Newgate, and that he this Dept. might safely go home
about his Business, and come again the next Morning by Nine O' Clock, or used
words to that or the like Effect, this Dept. did relying on what had been
told him by the said Smith to be true, about three O' Clock in the afternoon
of the same Friday the Indictment was found, leave the Old Bailey , and
go home to his Business, which he other wise should not have done, and
sometime in the same Evening the said Snowden was tried and discharged
for want of Prosecution as he hath been informed And this Dept. further Possitively saith that he
fully intended to prosecute the said Snowden for the said Offence, [..]
[..] and it was not out of favour, or for gain, that made him go home,
but only as before Stated, and if this Dept. had thought the Trial of the said
Snowden would have come on that day, he Possitively on his Oath saith
that he should have staid and given Evidence against him, as by his
Recognizance he was bound to do it being this Dept. Firm Rosolution to-
in Prosecute the said Snowden for the said Offence And this Dept. further saith that should not this Honble Court order
his Recognizance to be discharged it will be the Rain of this Deponent.
