maketh oath and saith that he this [..] Deponent
hath endeavoured to serve oneBarrett a Material Evidence
for the Prisoner with a Subpoena to appear here this day but this
Deponent could not meet with said Barrett to serve him And this
Deponent further maketh Oath and saith he apprehends from
Instructions he has received this Morning since in Court that he
shall be Able to Subpoen him this day And this Deponent apprehends
and verily believes it would be unsafe for the said Prisoner to be Put
to Tryal without the Evidence of said Barrett
