the Prosecuter in this Cause Maketh Oath and<lb></lb>
Saith That on or about the <rs type="date" id="LMSMPS50297_date29">ninth of October Last</rs>

Dept Beat and Brused This Dept. in such Manner That her life <lb></lb>
was Dispaired of and at the then next Sessions This Dept. Indicted <lb></lb>
the said Deft and Caused him to be Taken up thereon By a <lb></lb>
Bench<del>aeh</del>
Warrant which he Imediatly Bail to and <lb></lb>
the same Sessions gave Notice and pleaded guilty to the<lb></lb>
Same upon which This Dept. and her Witnesses attended <lb></lb>
and Acquainted This Court The Nature of ye offence and <lb></lb>
upon That he was Very much repremanded and sent out <lb></lb>
to agree with This Dept. upon which this<del>Informa</del>
Dept<lb></lb>
went out with him and Could not Come to An agreement <lb></lb>
<del>with him</del>
and Came into Court again with him and then the <lb></lb>
Court was pleased to Order him to <rs type="placeName" id="LMSMPS50297_geo65">New prison</rs>

for want <lb></lb>
of Sufficient Sureties, for his appearance the then Next Sessions <lb></lb>
to have a fine Sett on him and This Dept. further Saith <lb></lb>
That In four or five days following This Dept. had Notice <lb></lb>
of Bint from the said Dept before Justice Lambert This <lb></lb>
Dept. being the Sick In Bed and Could not Stir out by reason <lb></lb>
of the Bruses so reced as aforesaid which Madan Inward <lb></lb>
Ulcer In her Side and that she Vomitted Blood and Corruption for some <lb></lb>
Time which Ulcer Still Continues and at this I Dept. is Informed <lb></lb>
by her Surgeon She never will be right well again upon which <lb></lb>
Notice This Dept. Caused her said Husband and the Surgeon <lb></lb>
to Attend and oppose his being Bailed upon which as This<lb></lb>

Dept. is Informed appears by <lb></lb>
the recognizances returned That the same Day Bail was <lb></lb>
Taken for the sd. Dept before Justice Middford without any <lb></lb>
further Notice given and That This Dept. Saith that She<lb></lb>
did not Know of the said Dept being Bailed Till the same <lb></lb>
Night he Came home and That Mr Justice Middford refused <lb></lb>
to give an Account who the Bail were and That This Dept. <lb></lb>
was Obliged to Search In the said recognizances returned for the names and <lb></lb>
hath enguired after the same and find them Insufficient</p>
