writings and in the Pocketts of his wearing Apparell but hath not<lb></lb>

of his said Recognizance And this Deponent further Saith that the<lb></lb>
said Bill of Exchange if so lost or destroyed was merely by Accident<lb></lb>
and entirely without the knowledge or privity of this Deponent and<lb></lb>
that if he this Deponent could have found the said Bill of Exchange<lb></lb>
he would have prosecuted the said Prisoner pursuant to the prosecutor<lb></lb>
entered into by turn for that purpose as he intended to have done at<lb></lb>
this present Session And that the Sole reason that this Deponent doth<lb></lb>
not prosecute the said Prisoner as aforesaid is not being able to<lb></lb>
find the said Bill of Exchange without which he is Advised he<lb></lb>
cannot do And this Deponent further Saith that he hath not<lb></lb>
Sureted parted with or disposed of the said Bill of Exchange or <lb></lb>
permitted any person or persons to take away or secrete the same<lb></lb>
not doth he know or hath ever heard that the same hath been taken<lb></lb>
away or ever found by any person or persons whatsoever or hath he<lb></lb>
this Deponent done or consented to do any thing to screen the said<lb></lb>
George Stephen Hearsey from punishment through favor or<lb></lb>
Affection toward the said Prisoner or any other person whatsoever<lb></lb>
or by or through the means of any Gain Gratuity profit Reward<lb></lb>
or the keper or promise thereof or that the said prisoner might<lb></lb>
Escape Justice for the said offence or for any other reason or motive<lb></lb>
Whatsoever.</p>
