in whose custody this Deponent then was to bring him up into this honourable Court by Ten of the

clock the next morning in order to take his try at on the said Indictment And this Deponent saith

that having had no notice of the said Indictment being preferred and found till late on Thursday

Evening last and not having been ever examined by any Magistrate on the matter of the

present charge he was totally in prepared to take his tryal on the said Indictment at that time

therefore moved this honourable Court that his tryal might be put off till the last day of the

lb

present Sessions that he might have an opportunity to prepare for his Defence which the

lb
>
Court were pleased to order accordingly. And this Deponent saith that being informed that it

was possible the Sessions might end on Saturday last he in the best manner he could

>
prepared for his defence and to take his trial on that day and for that purpose caused several
