severally maketh oath and say and first this Deponent <rs type="persName" id="LMSLPS15080_n3-4">Moses Alexander</rs>

for himself saith that on Thursday last the Prosecutor preferred a Bill of Indictment against this<lb></lb>
Deponent for Forgery which the Grand Jury the same evening return a true Bill and an<lb></lb>
Habeas Corpus was left that Evening by the Prosecutor or his Sollicitor with the Warden of <rs type="placeName" id="LMSLPS15080_geo3">the Fleet</rs>

<interp inst="LMSLPS15080_geo3" type="type" value="undefined"></interp>

in whose custody this Deponent then was to bring him up into this honourable Court by Ten of the<lb></lb>
clock the next morning in order to take his try at on the said Indictment And this Deponent saith<lb></lb>
that having had no notice of the said Indictment being preferred and found till late on Thursday<lb></lb>
Evening last and not having been ever examined by any Magistrate on the matter of the<lb></lb>
present charge he was totally in prepared to take his tryal on the said Indictment at that time<lb></lb>
therefore moved this honourable Court that his tryal might be put off till the last day of the<lb></lb>
present Sessions that he might have an opportunity to prepare for his Defence which the<lb></lb>
Court were pleased to order accordingly. And this Deponent saith that being informed that it<lb></lb>
was possible the Sessions might end on Saturday last he in the best manner he could<lb></lb>
prepared for his defence and to take his trial on that day and for that purpose caused several<lb></lb>
persons to be Subpand and requested several others to attend who were not Sub<obscured></obscured>
to<lb></lb>
give evidence on his behalf and whom this Deponent thought material for that purpose and<lb></lb>
also caused an Habeas Corpus Testificandum to be left with the Warden of <rs type="placeName" id="LMSLPS15080_geo4">the Fleet</rs>

this Deponent late Partner who is a Prisoner for<lb></lb>
debt in custody of the said Warden to give evidence on this Deponent behalf on the tryal of the<lb></lb>
said Indictment this Deponent intending to be tried thereon on Saturday last if he could and<lb></lb>
verily believes that most or all of his Witnesses who were Sub<obscured></obscured>
or requested to attend<lb></lb>
did attend most or greatest part of that day to give evidence on his behalf And this Depont.<lb></lb>
saith that Yesterday about nine of the clock in the morning he recieved the Letter hereunto<lb></lb>
annexed from John lives who is a principal and material Witness for this Deponent on his<lb></lb>
said tryal and which Letter is all of the said John lives. Handwriting this Deponent being<lb></lb>
well acquainted therewith he this Deponent did therefore soon after request the other<lb></lb>
Deponent to go and if Possible Find out what part of the Country the said John lives the<lb></lb>
writer of the said Letter was gone to and directed that if the said other Deponent could come<lb></lb>
at such information immediately to get an horse or carriage and follow the said lives to<lb></lb>
whatever place he was gone to and bring him book to give evidence this Denyon this</p>
