Property of persons unknown</p>
<p n="341">The reason of their being bound over to Prosecute<lb></lb>
was, that they are both Officers of the Customs &<lb></lb>
having Missd the Tobacco, there was reason<lb></lb>
to believe Smith had Stole it</p>
<p n="342">The Comr. of the Customs having had this Matter<lb></lb>
laid before them for their directions, do not think<lb></lb>
there is a Sufficient foundation to prosecute the sd.<lb></lb>
Smith for felony, and therefore have given directions<lb></lb>
to their Sollicitor to move the Court for the discharge<lb></lb>
of the sd. Butts & Clapinsons Recognizance</p>
<p n="343">The Prisoner is not in Custody</p>
