maketh Oath and saith that he was on the twenty fifth Day of February<lb></lb>
last being the first Day of the last Sessions bound over to prosecute the sd.<lb></lb>
Deft for shealing divers Goods of this Deponents and that he preferred an<lb></lb>
Indictment on the same Day at Hicks Hall against the said Deft for the<lb></lb>
said Felony and came down to the <rs type="placeName" id="LMOBPS45005_geo3">Old Bailey</rs>

immediately after the<lb></lb>
Finding thereof and attended there from time to time until Friday Morning<lb></lb>
following And this Deponent saith that on the said Friday Morning he<lb></lb>
came to the Old Briley about ten of the Clock in order to give Evidence<lb></lb>
against the said Defendant and waited till one of the Clock in the Afternoon<lb></lb>
and not hearing his Name called he made Enquiry of several Persons about<lb></lb>
the same some of whom informed this Deponent that the sd. Deft had<lb></lb>
been acquitted for Want of his appearing against her about Eleven of the<lb></lb>
Clock that forenoon by which Means his Recognizance became forfeited And<lb></lb>
this Deponent saith that though he attended in the Sessions House Yard<lb></lb>
all the time aforesaid yet he did not hear his Name called and verily<lb></lb>
believes that the same arose from the Hurry and Confusion that was<lb></lb>
occasioned by the Trial of Mr. Sutton and saith that the said Defendants being<lb></lb>
acquitted as aforesaid was a great Surprize upon this Deponent and that he<lb></lb>
did not neglect to appear against the said Defendant with any View to<lb></lb>
favour the said Defendant and most humbly hopes that this Court will<lb></lb>
be pleased to discharge his said Recognizance</p>
