<p n="1561">which was accordingly done by the Order of this Court and<lb></lb>
he kept the Same in his hands a considerable time and<lb></lb>
then desired to have the original Book which by another<lb></lb>
order of this Court was also sent him and after he had<lb></lb>
kept that in his hands Several Months he returned it wthout:<lb></lb>
Settling the account the Ballance whereof as appeared by the<lb></lb>
said book war Two hundred Sixty four pounds add money<lb></lb>
due to the Hospital and that Mr. Baker has been Sent to several<lb></lb>
times suite and was now come to Speak to the Court then<lb></lb>
Mr. Barker being called in was asked if he agreed<lb></lb>
to the Ballance of his fathers account to which he answered<lb></lb>
that he was an utter Stranger to the account and had depended<lb></lb>
upon his Brother Lutterell who has not thought fitt to Settle it<lb></lb>
and therefore desired a few days to Look into his fathers Books<lb></lb>
adding that he would readily pay the ballance as Soon as he<lb></lb>
was Satisfied what it was and interest from the death of<lb></lb>
his mother which is about four years dureing which time<lb></lb>
he acknowledged he had made use of the money But that his<lb></lb>
Mother who was Admrx to his father has always kept the<lb></lb>
money by her and therefore he hoped the Court would not<lb></lb>
insist upon any Interest for it dureing her life Whereupon<lb></lb>
it is Ordered That it be Referred to the Comee of this House<lb></lb>
to Settle the said account with him and to Report to this<lb></lb>
Court how much they find due thereon with their<lb></lb>
