that they had advised with Counsel respecting their liability to<lb></lb>
answer the claim of the Governors and were advised that under all<lb></lb>
the circumstances such claim could not be supported; that they<lb></lb>
still hoped that the Committee would entertain the same opinion<lb></lb>
but if otherwise and the question must be litigated that Mr.<lb></lb>
Maddock had instructions to appear and defend the Action.</p>
<p n="964">Whereupon Resolved that it is the opinion of this Committee<lb></lb>
that an Action or Actions be forthwith commenced & prosecuted<lb></lb>
against the parties for non performance of the Contract.</p>
