99. JOHN PEARSON proceedingsdefend was indicted for stealing, on the 3d of January , one bacon ham, containing eighteen pounds, value 12 s. the property of Charles Pearcey proceedingsvictim .

I observed the prisoner going out of my larder door, with a bacon ham, on the 3d of January.

WILLIAM WARREN < no role > sworn.

I saw the prisoner come out of the house with something in his hand; he walkedon, I did not see him stopped; Mr. Pearcey came out of the door, I told him there was the man, and Mr. Pearcey stopped the man; he was never out of my sight till he was stopped.

PRISONER's DEFENCE.

I never was in the house, I was on the other side of the way.
