805. SAMUEL POOLE proceedingsdefend was indicted for feloniously stealing, on the 25th day of August last, 40 lb. weight of lead, value 2 s. belonging to Joseph Braine proceedingsvictim , and then and there affixed to a certain building of his, against the statute .

Between eight and nine the 25th of August, I was on the watch, I thought I heard somebody at the bottom of the ladder; I saw the prisoner with the lead under his arm; it was dark, I could not see him before I took him at the foot of the ladder; says I, what have you here, says he, a bit of something I am going to lay down.

THOMAS BRAINE < no role > , Jun. sworn.

This was our lead; it was tore off entirely.

Prisoner. I picked it up at the foot of the ladder.

GUILTY .

Transported for seven years .

Tried by the first Middlesex Jury before Mr. Baron HOTHAM < no role > .
