9. Richard Commins proceedingsdefend , was indicted for stealing one pewter pint pot, value 1 s one copper pot value 2 s. and other things , the goods of William Flemming proceedingsvictim , Oct. 26 .

William Flemming < no role > . The Prisoner lodged with me, and I lost several things, but found none of them again, but this pint pot; which was taken upon him, and he confest he took it from my house

John Hodgskins < no role > . Deposed the same.

Prisoner's Defence. I lodged in the prosecutor's house, five or six months, his wife and I went out to receive some Prize money, upon my return wanting some small beer, I took that pot and went out to get some; but meeting a shipmate, he asked me, where I was going with that pot? I said, what is that to you, then they took me before the justice.

Acquitted .
