John Wright Nemark proceedingsdefend , was indicted, for that he together with George Stracy < no role > , not yet taken, and Benjamin Henry < no role > , did break and enter the dwelling house of John Leydon proceedingsvictim , and stealing out thence one damask table-cloth. val. 10 s. nine napkins, one silver streamer, and other things the goods of the said John Leydon < no role > , Dec. 26 .

The only evidence here was Benjamin Henry < no role > an accomplice.

The prisoner was acquitted .
