Simon Aylmore proceedingsdefend , of St. Brides , was indicted for privately stealing a Canister of Bohee Tea, Value 1 l.1 s. out of the Shop of Humphrey Thare proceedingsvictim , the 21st of April last. John Row, the Prosecutor's servant deposed, that the Tea was put up for a Gentleman and laid in the Window, and that he saw the Prisoner take it, whereupon he cry'd out stop Thief, and followed and took him within.a few Yards of the Shop. The Person who stop'd him deposed that he saw him take it and throw it away. The Prisoner deny'd the Fact, and said that having been exercising at Westminster, his Officer gave him Money to drink, and that he was drunk; but he called none to prove it, nor any to his Reputation The Jury found him Guilty . Death .
