William Shaw proceedingsdefend of St. Anns Westminster , was indicted for feloniously stealing several pieces of Diaper, value 80 l. in dwelling House of Sir John Lock proceedingsvictim , the 25th of July last: The Prosecutor deposed, that the Prisoner was his Servant , and that he having been in Holland, had bought the said Diaper for the use of his own Family, which standing in a Box in a Parlour, he went to Tunbridge, his Lady being to come down thither in a Day or two, and the Prisoner to come along with her; that he being gone his Lady ordered the Prisoner to bring up the Box, in which the Diaper was, in order to her backing it up: he brought up another Box: his Lady telling him it was not the right Box he told her the other Box was empty. That thereupon when his Lady come down to Tunbridge, the enquired of Sir John what was become of the Diaper, telling him what had past between her and the Prisoner; be suspected the Prisoner, and taxing him with it, be deny'd knowing any thing of the matter; and coming to down and putting an Advertisement in the News and making Search in the Prisoner's Wife's Lodgings, but not finding it there, he got intelligence that the Prisoner had carried a Box from thence in a Coach to another Place, and so finding the Coachman he showed him the Place where it was left; and there he found it. Another Evidence deposed that it was brought and left there by the Prisoner before he went to Tunbridge. The Prisoner pleaded that his Master having ordered him to send a pretty many Boxes down to Tunbridge, he remembered the Number but mistook one of the Boxes; and that he thinking the Box that Linnen was in a fit Box for his own Clothes, took out the Linnen and carried it out, designing to get another Box to put it in, and then to put that Box and the Diaper in the same place again in his Master's House, but had not an opportunity to do it before the matter was discovered; but did not design to rob his Master of the Linnen. But the Jury not admitting his Plea, found him Guilty of the Indictment. Death
