William Smith proceedingsdefend , and John Hanson proceedingsdefend of the Parish of St. Botolph Bishopsgate , were indicted for feloniously stealing a Silver Tarikard, value 6 l out of the House of Thomas Moor proceedingsvictim , on the 27th of March last. It appear'd by the evidence, that the Prisoners, with another not taken, went into the House of Mr. Moor aforesaid, and call'd for a Tankard of Beer (Smith having been there the Day before.) which was accordingly brought them by the Prosecutor's Daughter: Then Smith, whose Part it was to make himself acquainted with the Landlord to prevent Suspicion, ask'd him several intimate Questions and told him he had measur'd out many Bushels of Oysters for him (having inform'd himself before that that was his Business) and came purely out of Love to see him: But Mr. Meer, who was under some Concern for the Tankard, not being so easily deceiv'd, kept an Eye upon his new Acquaintance, and observ'd the other Prisoner to go often out, under as many Pretences: At last, the Scheme being settled, Hanson ask'd the Prosecutor's Daughter which was the Way to old Bedlam, and being directed went out, but immediately came in, and spoke aloud to his Confederates, Sue's at the Door, but she won't come in, and went alway, another Person who was with ' em in Plate Buttons, but not taken, replied, Then I'll fetch her in, and stepping to the Door, held it open till smith made a clear Passage with the Tankard, it being now near Night; however, he was pursu'd and taken, being much soil 'd with the Beer that was in it, as he carried it under his Coat. It was very plain the Prisoner Hanson was principally assisting and abetting in the Felony; and the Jury found them both Guilty of the Indictment.
