Francis Child proceedingsdefend , of the Parish of Alhallows Barking , was Indicted for feloniously breaking the Warehouse of Michael Perrey proceedingsvictim , Thomas Lane proceedingsvictim , and Richard Perrey proceedingsvictim , and privately stealing thence 83 pound weight of Tobacco, value 3 l. on the 18th. of September last . The Evidence deposed, that the Prisoner came to him about Eleven a Clock at Night, and ask'd him if he would Drink; upon which he consented, but the Reckoning being to be paid, the Prisoner had no Money to pay, upon which he desired him to tarry till he fetcht some; which he did; then he askt him, if he would drink any more, and he replyed, no; but the hour of Twelve being come, the Watchman went his Rounds, and in the mean time the Prisoner climbed up a Post, got upon a Pent-house, and so into the Warehouse, and tied a Sack to a Window by a Rope, but he was discovered by the Watchman putting the Goods into the Sack, upon which he slipt down by the Rope into a place between two Gates, where he could not make his escape, but was taken, and his Hands were found blistered by the Rope, He denied the Fact, saying, he was a New England Man born, was in Drink, and fell asleep there before the Gates were shut, and denied he ever saw the Watchman before in all his Life. The Jury thereupon considering the matter, found him Guilty under the value of 5 s.
