James Arthur Mc. Donnell< no role > of Osborn Street in the parish of
Saint George in the County of Middlesex Gentleman maketh
and saith that (his late Master) William Finlay< no role > Attorney for
the above named Appellants departed this Life on the twentieth
day of March instand and that in Consequence of his Death
the Executors of his Will immediately took possession of all the
papers Writings and other Documents relating to the Business
of the said William Finlay< no role > and that this Deponent as Clerk to
John Cater< no role > of Norwood in the County of Surry Gentlemen
the above named Appellants Attorney could not procure the
papers relating to the said Appeals off the Executors of
the said William Finlay< no role > before Tuesday last at about
Eight O'Clock in the Evening nor could he this Deponent
procure the Report of John Morgan< no role > of the Inner Temple
London Esquire the Referree appointed by this honourable
Court with the Consent of the parties before Ten O'Clock
in the Evening of the same Tuesday

And this Deponent also saith that the above named
Appellants have several necessary Observations to make on
the Report of the said John Morgan< no role > but that there was not
sufficient time to instruct their Counsell for that Purpose
nor are they the said Appellants in any wise ready to hear
the Judgement of this honourable Court touching the said
Report and Appeals
