dispose of the same & apply the money to be raised by such sale for the purposes of this Act"

By the 6th. Sectn Bodies politic & all other psons are enabled to convey Lands Etc which
shall be deemed necessary for the purposes of this Act

By the 8th. Sectn.. It parties refuse to treat for Lands Etc deemed necessary Etc a Jury to be
Summoned to set a value thereon when Verdict is to be final

By the 11th. Sectn.. upon paymt. of money so ordered to be paid for the purchase of
such Lands Etc the same shall rest in the person authorized to held the same by virtue
of this Act for the purposes assd.

It is to be observed that the Act 24th. Geo. 3d.. for rendering more effectual the Laws
relative to Houses of Correctn.. was made at the same time copied from & meant to give the same
powers to the Justices of the Peace respecting Houses of Correctn. That the Stat. of 24th Geo:
3d. gives to the Justices respecting County Goals but the 5th Sectn of the County Goal Act wch
Gives an express power to the Justices to purchase Lands is by mistake omitted in the
House of Correctn. Act the Sevr. Clauses in that Act seem to imply such a power

Qn: 1st

Whether the Justices of the peace in Session are authorized by the Act of the
24th. Geo: 3d: to raise Money on the Bonds there specified for the purchase
of Lands to build a House of Correction?

This Statue of the 24th. Geo: 3d. is not accuratly perd; but stands upon
true authorities of the several that of the 17 g.l. 22d G.l. this statute, the Justices of peace an authorized to rates money on the securities specified as
for the Purchase of Lands & Cold an House of Correction upon, as for facility such House, when the Estimate including the value of the rate of the
agr, exceeds one half the County rate, under the general authority given them to remove should Etc.

Qn. 2d

Wher. the Act of 17th. Geo: 2d. does continue in force to enable the Justices
in Sessions (the proper Forms of Presentent. Etc required by the sd. Act having
been regularly taken) to levy the Sum of money necessary for the purchase
of such Lands (such Sum beeing more than half the usual County rate)
notwithstanding the Clause respecting charges in the County rate in the Act
of 24th.. Geo:3d

The Justices have no power under the 2d. charge of the 24 g. 3d. to mortgage the County rates, if
the Estimate of the Expence, does not exceed one holy of the County Rate; but if it exceed, that been they may charge the County rates with such sum as shall appear
necessary & expendent for the Purpose of the Ret, which I intime to I [..] leases it his that [..] of the Justices at the repairs either to rain sum open the audit
of the rates, if they statmnts & necessary Lease direct or to resin the whole according to the Desire her of the forther Act. If it shoud be held or that the
Justices have no authority to incluse the purchase money of Land purchased to build upon in the hirmatt & use to change it,by way of murtgage upon the latter
they must raise such purchase Money by the current County rate; for the 21 g.3d. certainly does not take away the power of the Justices to purchase Land
for the purpose of building an House of Correction.
