Chas Eyles soveraley make Oath & say And first the sd Daniel Hinley <lb></lb>
for himself maketh Oath & saith that he hath been clerk to the sd Chas<lb></lb>
Eyles in the office of the Clerk of the Peace for the County of middx upwds<lb></lb>
of 8 Years 7 years where of this Dept was the second Clerk in the sd office<lb></lb>
And the sd Jno Harwood for himself Saith that he was Clerk to the said<lb></lb>
Chas Eyles very near 9 Years & both these Depts Say that the Sessions for the<lb></lb>
sd County of Middx are held under two commissions one a Commn of the<lb></lb>
peace & the other a Commn of Oyer & Terminer and these Dept further<lb></lb>
say that at such Sessions the Justices of the Peace & the Justices of oyer<lb></lb>
& Terminer sit together upon the same Bench & that both Commons are<lb></lb>
usually opened & proclamations made under the same on the first<lb></lb>
day of Sessions holden at the said Sessions house And that the<lb></lb>
same persons serve as a Grand Jury & an Sworn under both Commns<lb></lb>
& that the Acts & proceedings of the Court at the Sessions both as Justices <lb></lb>
of the peace and as Justices of Oyer & Terminer are entered in a<lb></lb>
Bood endorsed with the Title of the Session of the peace which Book is<lb></lb>
ever since these Depts have been in the sd Office & long before as appears to<lb></lb>
them by the Records of the sd Sessions hath been made out in the follow &<lb></lb>
manner Vizt the first Leaf thereof is left in blank for a list of the Names<lb></lb>
of such Justices as may be present each day of the Sessions to be<lb></lb>
inserted therein The second Leaf thereof for the insertions of the Memdum <lb></lb>
of the days of holding the Sessions of the Peace with the Names of such<lb></lb>
Justices of the Peace as may be present during the holding such<lb></lb>
Sessions The third leaf thereof for the Memdums of the days of holding<lb></lb>
the Sessions of Oyer & Terminer with the Names of such of the Justices<lb></lb>
of Oyer & Terminer as may be present dweing the holding of such<lb></lb>
Sessions & the 4th Leaf is left for the Insertion of the Names of the<lb></lb>
Grand Jury & Traverse Jury under both Commns & for a short Minute<lb></lb>
of the several Adjournmt of the said Sessions held under both the sd<lb></lb>
Commrs & the rest of the Book is appropriated for the Entry of other<lb></lb>
Business of both Sessions & for a fair list or Calendar of the several<lb></lb>
Indictments found by the Grand Jury at such Sessions And</p>
