Samuel Harman< no role > of Jermyn Street in the Parish of St. James
Westminster in the County of Middlesex Gent Attorney for the Defendt.
in the above Indictments maketh Oath & Saith that the said Indictment
came on to be tried yesterday at the Sessions holden at the Guildhall
Westminster when the Defendt was found Guilty & the Court was pleased to
set a Fine on the Defendt of Forty Pounds on each Indictment subject to
such Terms as the Defendt. should agree upon with the Prosecutrix and
Prosecutor of the said Indictmts. and this Depont. saith that the sd Defendts
being then unable to pay the said Fines he this Depont. did on his behalf
propose to Mr. Deacon Attorney for the Prosecutrix Prosecutor to
pay to them the Sum of twenty Pounds in him of the said the Fines of
forty Pounds which the said Mr Deacon refused to accept but insisted on
the Sum of thirty Pounds which he said the Prosecutor would accept
And this [..] Depont. further saith that he did with difficulty [..]
procure the said Sum of thirty Pounds and was ready he pay the same
and was preparing a Petition to the Court to mitigate the said Fines
accordingly but before the said Petition was finished the said Mr Deacon
went away having before he left the Court signified his Consent to Mr
Eyles the Clerk of the Peace that if the Deft left the said thirty Pounds in
his the said Mr Eyles's hands he should have no Objection to the Defendants
Discharge as this Depont. is informed & verily beleives And this Depont.
Saith that he was ready to pay the said thirty Pounds to the said Mr Eyles
but being informed that it was necessary that the Prosecutor & Prosecutrix
or the said Mr Deacon their Attorney should be present to consent to the
said Petition and the said Mr Deacon being gone away & not being able
to find him this Depont. applied to the Prosecutrix & Prosecutor & desired
them to attend the Court to accept the Money & consent he the said Petition
but they declared that they had left this Matter to the sd. Mr Deacon their Attorney
to settle & as he was gone and they did not know where he find him they
