of Brown or his Wife . The Writ was allowed: and Brown applyed for a
venere in order to be tried at the Sessions declaring himself adverse to the
being tried elswhere. The writ was returnable on the morrow of all routs
and the Indictment still lay in the Office. The question therefore was
whether this Court could proceed to the trial of the Browns and in these
circumstancesthe [..] and the Court inclined to the opinion that they
could not proceed then jurisdiction in this case being suspended by this words of the
