as aforesd. The sd. Court or assembly did then & there proceed to the Election of a Mayor & Bay liffs of the sd. Borro. for the Year then next Ensuing
And the Candidates for the Office of Mayor of the sd. Borro. then & there were Mr. Samuel Watson< no role > Mr. Stepn. Read< no role > & Mr. Thos. Towle< no role > all
three of the Council or Aldermn. of the sd. Borro. And thereupon the sd. Saml. Watson< no role > 57 Voices & the sd. Stepn. Read had had 43 Voices & the sd.
Thos. Towle had two Voices & no more where upon the sd. Wm. Beadall< no role > & Wm. Blount< no role > respectively then & there declared the sd. Samuel

< no role > to be duly Elected Mayor of the sd. Borro. for the Year then next Ensuing & at the same Court or Assembly Jno: Moor< no role > the Elder Edwd.
Collinson
< no role > Francis Moore< no role > Waite Walker< no role > Robert Ruston< no role > & Thos: Barker< no role > were Candidates for the Office of Bayliffs of the sd. Borro. and the sd.
John Moore< no role > the Elder had 52 Voices & the sd. Edwd. Collinson had 52 Voices & the sd. Francis Moore< no role > had not above 40 Voices and the sd.
Waite Walker had not above 40 Voices and the sd. Robt. Ruston had not above 20 Voices and the sd. Thos: Barker had not above 20 Voices
Whereupon the sd. Wm. Bead all & Wm. Blount respectively then & there declared the sd. John Moore< no role > the Elder & Edwd. Collinson to be duly
Elected Bayliffs of the sd. Borro. for the Year then next Ensuing and these Depts. further Severally say that on the next day being the 28th, day
of September last about ten of the Clook in the Morning Mr. Henry Waterland one of the Council or Aldermn. of the sd. Borro. & Several of the
Burgesses of the sd. Burro. Assembled at the Town Hall of the Borro. in order to proceed to another Election of a Mayor & Bayliffs of the sd.
Borro. under a pretence that there was not any Election of Mayor & Bayliffs made on the day before and that the sd. Wm. Bead all & Wm.
Blount both then & there attended & presided & tho' the sd. Wm. Beadall & Wm. Blount were both then & there present the sd. Henry
Waterland took upon him self to preside at that assembly al tho the sd. Wm. Bead all & Wm. Blount respectively protested agt. his so doing
And these Depts. further severally say that at that assembly there was another Election proceeded to & made of a Mayor & Bayliffs of the sd.
Borro. for the year then next Ensuing and the sd. Henry Waterland< no role > then & there declared that the same was so done pursuant to the
Statute in such Case lately made and Provided because there was no Election made the day before or to that or the like Effect and
these Depts. further severally say that the same persons were then Candidates for the sd. Sevl. Offices of Mayor & Bayliffs that were
Candidates the day before as aforesd. And that thereupon the sd. Saml. Watson had 46 Voices & no more The sd. Stepn, Read had 35 Voices
& no more and the sd. Thos. Towle had only one Voice The sd. Jno. Moor the Elder had 42 Voices & no more the sd. Edwd. Collinson had
42 Voices & no more the sd. Francis Moor< no role > had not more then 34 Voices the sd. Waite Walker had no more then 34 Voices the sd. Robt.
Ruston had not more then 20 Voices & the sd. Thos. Baker had not more then 20 Voices Whereupon the sd. Wm. Beadall & Wm. Blount
respectively then & there declared the sd. Saml. Watson to be duly Elected Mayor & the sd. John Moor< no role > the Elder & Edwd. Collinson to be duly
Elected Bayliffs Notwithstanding which the sd. Henry Waterland well knowing the great Majority of Voices that were in favour of the sd.
Samuel Watson< no role > for Mayor and also the great Majority of Voices that were infavour of the sd. Jno. Moor the Elder & Edwd. Collinson for Bayliffs
then & there declared the sd. Stepn: Read to be duly Elected Moyor and the sd. Francis Moor< no role > & Waite Walder & to be duly Elected Bayliffs
& they were then & there respectively Sworn & Admitted into the sd. respective Offices by the sd. Henry Waterland Notwithstanding the
sd. Wm. Bead all & Wm. Blount respectively then & there respectively protested agt: the same and these Depts: further severally saith to the
29th day of Sept last (being Michas day and the adual day for Swearing in the Mayor & Bayliffs for the sd. Borro. of Hedon) at the down
Hall aforesd. the sd. Saml. Watson was then & there duly sworn & admitted into the Office of Mayor of the sd. Borro. for the Ensuing year
by & before the sd. Wm. Beadall & Wm. Blount respectively & thereupon the sd. Wm. Bead all then & there delivered to the sd. Samuel
Watson
< no role > the Comon Seal of the sd. Borro. and also the Regalia of the sd. Borro. according to the usage & Custom of the sd. Borro. & there upon
the sd. Samuel Watson< no role > took upon himself the place & office of Mayor of the sd. Borro. But the sd. Wm. Bead all & Wm. Blount did then
& there refuse to swear & admit the sd. Stepn. Read into the Office of Mayor as he was not Elected and they did then & there also refuse
to Swear & admit the sd. Francis Moor< no role > & Waite Walker respectively into the Office of Bayliffs as they or either of them was not
nor were not Elected and that at the same time & place the sd. John Moor< no role > the Elder & Edwd. Collinson were respectively sworn &
Admitted into the Office of Bayliffs of the sd. Borro. for the Ensuing Year by & before the sd. Wm. Bead all & Wm. Blount respectively &
thereupon they the sd. John Moor< no role > the Elder & edwd. Collinson respectively took upon themselves the place & Office of Bayliffs
of the sd. Borro. Notwithstanding all which the sd. Henry Waterland did then & there insist to Preside at that Court or Assembly & did
then & there absoluely & Peremptoily take upon him self to Swear & Admit the sd. Stepn: Read into the Office of Mayor and the sd.
Francis Moor< no role > & Waile Walker respectively into the Office of Bayliffs of the sd. Borro. Altho' the sd. Wm. Bead all & Wm. Blount were
then & there present & did then & there respectively protest agt: the same and agt: his the sd: Henry Waterlands so doing And
these Depts. do severally say that the sd. Stephen Read< no role > insists that the is the Mayor of the sd. Borro. And as such Claims & insists to
have & receive & hath actually recd. Coal dues claimed & of right received by the Mayor of the sd. Borro. and the sd. Francis Moor< no role > &
Waite Walker insist tha they are the Bayliffs of the sd. Borro. and that they will act as Bayliffs accordingly and the sd. Stepn: Read
hath acted as Mayor and the sd. Waite Walker hath acted as Bayliff by holding a Court of Sessions of the peace for the sd. Borro.
