maketh Oath That on the first Day of July Sessions last He issused
one James Aidems< no role > to be charged before Mr Justice Midford for
Stealing and taking away from and out of the Dwelling Remse of this
Deponent One pain of Breehes and our Burnishing oftens the
Propperty of his Depent. at Which time this Dept. was bound ever
to Prosecute the said James Elibrns for the said Offence the same
Sessions And this Dept. further Saith that in July Sessions last
The caused a Bill of Indictment to be Drawn [..] against
the said James Albens< no role > which this Dept. paid for and that his name
was put to the back thereof that He was Sworn thereto in Court
and Did Attend the Grand Jury thereupon and give Evidence accordingly
and that He hath upon Searching and Inquiry been informed that
the Same Bill was formd not to be a true Bill. And this Depont. also
Saith That He hath received notice from Mr Daniel Briston< no role >
That the above Recognizance Entred into for Forty Pounds would
be Entreated in the Exehequer not with standing He hath confirmed
to the Condition thereof as He humbly Concerns as is above expressed
and Sett forth. and this Deponant further Saith That He do's not
Know were the said James Elibens is or what House He Lives in or where
He is to be found.
