Indictment for Stealing from Jos. Dutton< no role > &
Willowbier Value Ten Pence

Joseph Dutton< no role > the prosecutor of this Indictment Maketh Oath that John Jane< no role > as a
Material Witness to prove the fact charged on the said Richard Black< no role > by the said
Indictment and that he the said John Jane is now at Taunton Deane in the
County of Somervet and is not Expected in Town for some time as this Depont.
is Informed and believes so that this Deponent can not have the Benefit of this
testimoney at a Tryal of a Traverse of the said Indictment this Sessiones and
this Deponent further Saith that he this Deponent hath lately several times made
diligent Inquiry after John Head< no role > by and Richard Rose< no role > two (another Material Witness for this Deponent.
in the premies) at all places where this Deponent had any knowledge or
Information that the said John Headley< no role > and Richard Rose< no role > was to be found or
heard of Not withstanding which this Deponent not as yet been able
to find shine or eithey of them out and this Deponent [..] Saith that he is advised and believs for that
the Testimoney of the Witness above named or one of them This Deponent
Can not Safely proceed to Tryaly of a Traverse of the Indictment above
mentioned And this Depont. Vertly believes their or some of them will [..] Town by
the next Sessions
