was discharged only this Honerab Court
on the Eight day of Decemb 1735 this defendent
haveing no Quarrill or Assult with the prossecutor
but one time which befoer the said first Indictmt.
was brought and that he this deponent doath

Knew that the defendent was discharged
on the Right day of December 1735 being the
day before the prossecutor proferd the Last
Indictment) this deponant further saith that

from the time of the first Indictment untill
he was taken up by a banch warrant
being obtained upon the seacond Indictment
