Oath that he delivered a true copy of the notice hereunto Annext to the Prosector

own hands at the Kings Bench prison
on the Twelth day of
this instant October
between the houses of Eleven and Twelve in the
forenoon of that day And this Deponent further saith that at the last
sessions of the Peace held for the said County the said Bennet Herle< no role >
was in
the marshalsy prison
detained at the suit of the said Hobbs for the same
pretended Assault for which he stands Indicted here, and remained there
as a prisoner for sometime And this deponent hath heard and verily
beleives that one Rowland Day< no role >
who solicits for the prosecutor did advise
add occasion the said Imprisonment And the said Bennet Herle< no role >

al severall times told this deponent and this deponent doth verily beleive
that he the said Bennet Herle< no role >
hath not one shilling in the world wherewith
to support himself or to trye this Indictment and that he is but newly
come out of Confinement
