Whereas by Order made at the last Sessions of Oier & Terminer
holden for this County by adjornmt. on Saturday the Sixteenth
day of July last It was ordered that Joseph Trueman< no role > Junr
Thomas Clarke< no role > & George Wheatly< no role > prosecutors of an
Indictmt. preferred against the Defdt. Thomas Charlesworth< no role >
for being a comon Barrator (to which he pleaded not
guilty) should exhibite articles of barratry against the sd.
Defdt.whereby he may be enabled to make his defence
and leave the same with the Clerke of the peace of this
County or his Deputy before the First day of this present
Sessions, Or in default thereof that the said Defdt. should
be discharged of the sd Indictmt; And personall notice
of the said order was forthwith to be given to the said
prosecutors, Now upon applicacon made unto this
Court by the sd Defdt. alledgeing that the said Joseph
Trueman
< no role > & Thomas Clarke< no role > prosecutors of the sd Indictmt.
were on the second day of August now last personally
served [..] respectively with a coppy of the said order (as by
affidt. [..] of one Anthony Butt< no role > now publiquely read appeareth
unto this Court) and that articles of barretry are not yet exhibited It was prayed by the said Defdt. that he
may be discharged of the said Indictmt:, This Court is
of opinion that the said Defdt. ought to give due notice
of trying his traverse upon the said Indictmt. unto the
prosecutors thereof in order to be regularly discharged of
the same,
