Defth. Surprised by the plts ledging an Appeals of murder agt
him yesterday morning requested this Deponent to find and gett his
Witness together in Order to his try all on the Appeals this present
Session and this Depoment Saith That he this Depoment used his
ulmost Endeavor soe to doe But Saith That two of the Defts.
witness wch. This Depont. is advised and believes to be very
material Evidences for the Deft. in this appeals con'd not be found
nor can as this Deft. beleiveth he produced at this Session but
as this Deft. believeth may and will be produced as witnesses
for the said Appealsoe at the next Session to be holden for
the County of Middx and would now have appeared for him
had this Depomt. had longer time to have enquired after
