hard Labour by the Court of Goal Delivery for the County of Middlesex
being the like Satisfaction as hath been usually paid to him for the Order of
Transportation of any offender Your Committee are of Opinion as
this Claim appears to Stand upon the same ground with that of Mr.
Deacons the Clerk of the Assaigns of the County of Middlesex under the said
Act which on Application to the Court of Kings Bench hath been
determined by the said Court in his favour, that the Treasurer do pay [..]
said Demand

That in respect to the demand made by the said
Richard Akerman< no role > of 13s/4d under the Act of Parliament of the 14th. George the
Third for the Relief of prisoners charged with felony or other Crimes who
shall be acquitted or discharged by proclamation respecting the payment
of fees to Goalers and giving a Recompence for such fees out of the Corm [..]
Rates for every prisoner who has been charged with felony or some other
Crime or as an Accessary thereto before the Court of General Goal Delivery
for the County of Middlesex against whom no Bill of Indictment hath
been found by the Grand Jury or who on his or her Trial have been acquitted
or who hath been discharged by Proclamation for want of proclamation
Your Committee have Caused diligent Search to be made at the
Office of the John Clerk of the City of London for Evidence and matter
touching this Claim of the said Richard Akerman< no role > This name instance is in set 4413. on which Evidence
they have formed the Case hereunto annexed and have obtained the
Opinion of Mr Bearcroft one of the Kings Counsel thereon

Here follows the Case above referred to

Case

The Goal of Newgate which is situate within the City of London in
the common Prison and place of Security for felons and other offenders a [..]
well for the City of London as the County of Middlesex ; and the Citizen
of London have, since the time of its Erection had the Government and
Management of it without any interference from the Magistracy a
Inhabitants of the County of Middlesex

The Citizens by Charter, have the Nomination and
appointment of the Sheriff for the County of Middlesex and the City of
London , The Sheriff usually nominates the Keeper of Newgate and the Cou [..]
of Aldermen receive such nomination and Confirm the appointment

The Court of Aldermen of the City of London have
uninteruptedly exercised this right of Appointment have from time to the
regulated the Keepers fees and Conduct and the interror [..] sonomy of
Goal and have and do yet asusually allow him a certain Sallary at
the Chamber of the City the amount of which has varied
