said John Clarke< no role > and Mr. Deacon then informed said Mr. Jarvis, that the
Jury were Discharged and that he had not received any Indictment against
the said John Clarke< no role > but that there were Two prisoners of the Name of Clarke
and therefore he imagined that the Clerk at Hicks Hall and misinformed these
Deponents And these Deponents further Severally Say That they have since been
informed (which Information they believe to be True) that the aforesaid Bill of
Indictment was returned by the Grand Jury and that they Wrote upon the back
of the same that the Witnesses had been called but that they did not appear to
give their Evidence thereon And these Deponents have since been informed that
their said Recognizance is become forfieted and that the same will be Estreated
into his Majesty's Court of Exchequer if not Ordered to the Contrary by this
Honourable Court And these Deponents further severally Say That the Neglect
aforesaid was not occasioned through any favour or Affection to the said John
Clarke
< no role > or any Reward or the hope or promise thereof but that such Neglect
was occasioned by the means aforesaid and through no other reason or motive
whatsoever And Lastly these Deponents Say That they have been informed
(which information they believe to be True) that the aforesaid John Clarke< no role >
was at the said last December Session Discharged by proclamation there
being no Indictment against him. but these Deponents have at this present
Session preferred another Bill of Indictment against the said John Clarke< no role > for
the Felony aforesaid which Bill of Indictment is by the Grand Jury returned a
True Bill And that they will use their utmost endeavours to find out and Apprehend
the said John Clarke< no role > in Order that he may be Tried thereon.
