and that he Only Attended to take Letters and Messages and
was an Intire Stranger to the Law and cou'd give this Deponent no
Information of his Papers nor had any Instructions regarding the
Indictment and therefore this Deponent Saith he is entirely
Destitute of any Assistance from the said Mr Rigg Nor is this
Deponent able to Instruct any other person on his behalf to prepare
his defence for want of the Papers which are now in the Custody of
the said Mr Rigg And this Deponent Saith that he hath not in
his Custody nor can he come at any Papers regarding his Concerns with
the said Samuel Baylis< no role > nor is he prepared to give proper Instructions
to any other Attorney on his behalf to make a Defence for him on
the Tryal of this Indictment for want of the Papers in the Custody
of the said Mr Rigg And this Deponent further Saith that since he
Spoke to the said Mr Riggs Clerk he has been several times at the said
Mr Riggs Chambers in Order to have made further Enquirys after this
Deponents papers but this Deponent has not been able to see him
nor can he learn where he or his Master the said Mr Rigg is to be
met with Nor does this Deponent know And Lastly this Deponent
Saith that the Reverend Simond Paget< no role > a Material Witness for this
Deponent is now in the County of Gloucester as this Deponent
believes and would have Attended on this Deponents behalf at the
Tryal of this Indictment in Case he had been Sub paned but for want
of being to Sub paned he does not come to London And this Deponent
John Lucas< no role > for himself Saith that he entered into a Recognizance
with Mr George Newman< no role > of the said County of Gloucester for the said
John Staite< no role > to Appear and defend the said Indictment And that in
Consequence thereof he and the said George Newman< no role > came up to
London with the said Defendant on Tuesday last in Order to have had
the said Indictment Tryed but that the said Defendant has not
been able to meet with the said Mr Rigg or to get any Intelligence
from his Clerk regarding his papers so as to Instruct Council on his
behalf And therefore this Deponent verily believes the said John
Staite
< no role > is in no ways able to Prepare for his defence to the sd. Indictment
And this Deponent Saith that the said Simond Paget< no role > who is a
Material Witness for the said Defendant is now as this Deponent
believes in the County of Gloucester for that this Deponent saw
him there on Monday last and he then Informed this Deponent
that he would have Attended the Tryal of the Indictment on
the said John Staites behalf in Case he had been Subpaned but
for want thereof he thought it Unnecessary
