Arms lengththe peice was delivered to Deponent
and then the Deceased rushed up, and the Bayonet was
touched by him, and he said Fire away and be Damn'd
for he was the Sad that could stand twenty Balls, he
had fought for his King and County, and valued not
Deponent said to Deced if he did not desist he certainly would prick him
BallsDeceased then struck the Bayonet with his
Hand forcibly in order to wrench or strike it out of his hand
Deponent says that while the Deceased was shipping
off his Clothes, Knight the Gardner said to him if
he did not go away, he would Fire upon himDepont.
Said by [..] no means dont Fire, which he did not then
the Deponent kept parrying with his peice against the Deceased who
was resolutely persisting in endeavouring to get
the Piece from him, and at this time he heard the Report of a Gun
the Deponent was much surprized at Seeing the Deceds
being much changed, and his [..] abated and then gave the peice he had
to Mrs. Drakes Watchman, saying, see if this peice
her gone of for I am not sure whether it has or no
No Sir says Mrs. Drake's [..] Watchman it was
Knight the Gardner that fired Deponent then said

to Deceased Now [..] what a Silly Man you must be
had you taken my advice Nothing of this sort
would have happenedDeceased immediately retreated
two or three paces back and sat down on the Steps
Deponent gathered up his Cloaths and put them on
his Shoulder and clapping his hand there said My
Freind are you hurtthe Deced lift up his left hand
and gave Deponent a blow on the Face, saying
Yes Blast You I'm woundedDeponent saw
Blood about the Deceasedhe soon after went away
having word with Mrs. Drakes Watchman his Name where
he was to be found if wanted

Charles Montague< no role > House Surgeon to St. George's
Hospital in the Parish of St. George Hanover Square
on his Oath saith, that the Deced was brought to
the said Hospital Tuesday the 9th. of October instant
between Eleven and Twelve o'Clock at Night, shot
in both Thighs, every necessary care was taken of
him
