Berkeley Square in the County of Middlesex
the Defendant above Named Maketh Oath
and Saith That he this Deponent employed
Mr. Newby of Hamilton Street< no role > piccadilly as
his Attorney in this prosecution and who
as this Deponent is informed and verily
believes on Monday last caused notice of
Tryal to be served in this prosecution
for the present Session And this Deponent
further saith That he this Deponent yesterday
appeared before this Honorable Court with
his Witnesses for the purpose of taking
his Tryal upon this Indictment (the
Prosecution of which did not attend And
in consequence of the said Mr. Newby not
havinggivinggiven a regular Notice of
Trial, this Deponent was precluded from
being discharged.
