In regard to discharging the Prosecution
Recognizance for disch prosecuting me Thomas B
Banks for a Felony

of Saint James's Street
in the City
and Liberty of Westminster
and James Mc. Whinnie< no role >
of the
Strand
in the County of Middlesex
Hatter make Oath and
said That about the latter and of November or the
beginning of December last these Deponents caused one
Thomas B. Banks< no role >
to be apprehended for a felony in consequence
of which he underwent an Examination at Bow Street
and on the Evidence of these Deponents he was thereupon
committed by the Justices there to Tothill Fields
Bridewell
in order to take his Trial for the said Felony at the then
next and now last January sessions for the City and
Liberty of Westminster
and these Deponents thereupon
entered into Recognizance to prosecute the said Thomas B.
Banks for the said Felony upon which this Deponent
James Mc. Whinnie< no role >
then made inquiry at the said
Office in Bow street
aforesaid when the said sessions for
Westminster
would be held and he was answered by a
person there whom he considered belonged to that Office
and who was competent to inform this Deponent that the
said Sessions would Commence on the Thirteenth of the then
next January, and this deponent informed the other Deponent

thereof and this Deponent James Mc.
Winnie< no role >
further saith that about the sixth or Seventh Day
of January last this Deponent was informed by one
Richard Paget< no role >
a servant of the other Deponent William
Walker that he the said Richard Paget< no role >
had just then met
the said Thomas B. Banks< no role >
at large in the street at which
this Deponent James Mc Whinnie< no role >
expressed his surprize
and immediately went to the said Office in Bow street
to inquire how this could have happened but found the
said Office was sheet and he went again the next
Morning and was then informed that the sessions had
