John Rogers< no role > afterwards Ground Corn at the
Mill for [..] Between 2 & 3 years [..] He never resided thereon during that time but in Cottage
in the same parish which he rented at 3s.18d Pd annum

It was contended by the Counsel for the
Respondents that upon the face of the above
Articles of Agreement such an Interest in
the Mill passed to Thomas< no role > and John Rogers< no role >
as together without the before mentioned Residence to give John Rogers< no role > a Settlement under
the Statute 13 & 14 Car 2. c. 12 by his renting
a Tenement above the Value of £10 a year [..] But
the Court of Sessions being of a Contrary Opinion
quashed the order.

Now upon hearing the said appeal
This Court therefore upon Consideration of the premises doth Allow the said
appeal and doth vacate and set aside the said order of the said two
Justices and the said Appeal in hereby allowed and the said Order of the said
