Indicted on the Prosecution of James
Scott
< no role > for an Assault

William Bainbridge< no role > the above named Defendant maketh
Oath and Saith that at the beginning of the last Session he was
Indicted in this Court by the said James Scott< no role > for a pretended assault
made upon him by this Defendant and afterwards at the same Session
the said James Scott< no role > was Indicted in this Court for Assaulting and
falsely Imprisoning of this Defendant and at the same Session this
Defendant Pleads to the Indicted that had been found against
him and intended to have been Tried thereon at the present Session
but was presented therefrom because Terms of accommodating the
matters in difference between the said James Scott< no role > & this Deponent
had been proposed to this Defendant on his past but which the said
James Scott< no role > hath since receded from and this defendant saith
he humbly apprehendeth that unless his recognizance respited
so that both the said Indictments shall come on to be tried together
that compleat Justice may not be done to this Defendant from
the want of his Evidence on the said Cross Indictment against him and
this Defendant saith that his Bail are Consenting to have this
Defendants Recognizance respited of this Honourable Court
shall so pleased
