The King on the Prosecution of Frances Simpson< no role > Spinster
against
John D'Arcy Cusack< no role > Esqr . Stiler in the Indictment Laborer

John D'Arcy Cusack of Glouaster Street Queen Square Esqr.
maketh Oath and saith that the Bill of Indictment in the above
mentionex Prosecution was preferred and found against him
at the Sessions of the Peace held for this County in the Month of
June now last Passed for a Supposed Assault committed by this
Deponent on the said Frances simpson< no role > the prosecutrix above named
on the fourteenth day of March in he twenty eight Year of
his Present Majesty's Reign and which is now nearly Sixteen
Months ago And this Deponent further saith that he did not
either at not hath even since the said Time when the said
supposed Assault was committed absented himself in order
to elude this Prosecution And that on Account of the length of
Time having Clapsed since the said supposed Assault was
committed he is advised that he cannot with safety put himself
on his Trial According to the Condition of his Recognizance
by read [..] of several Material Witnesses which
he is informed are absolutely necessary for this Deponent
to bring forward and which he will be able to do by the
next sessions of the peace to be holden for this County
And this Deponent also saith that Gliddon who Acts as
Attorney or Solicitor for the prosecutrix herin hath declared
that he determined to convict the Deponent unless he
withdraws an Action he has commenced against one Walter< no role >
alias William Gough< no role > for assaulting and false imprisoning
this Deponent which declaration [..] in was this Deponent
to believe that the said Gliddon means to being false
Evidence and this Deponent furthe saith a Proper notice
hath been given to the Prosecutrix that he this Deponent
should move this Court to respite the Recognizance given in
this Prosecution to the next Sessions
